Affiliate Agreement

This agreement describes the terms and conditions for participation in the Pure Chat affiliate program. In this agreement, the term "Affiliate" refers to you (the applicant). In this agreement, “Pure Chat” refers to Pure Chat, Inc., a Delaware Corporation, with whom you are entering this agreement. By applying to the Pure Chat affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.

Affiliate Programs

There are two types of Affiliate programs with Lucaneo: one-time and recurring.

Commissions

For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.

If the Affiliate is on a one-time payment option, they will receive a commission for each new signup.

If the Affiliate is on a recurring payment schedule, they will continue to accumulate commissions for each paid transaction by the customer for as long as the customer remains a paying customer. For Affiliates participating in the recurring program, commissions will also accumulate for plan upgrades and adding users.

Payment

An Affiliate can request a payment when their balance reaches a minimum balance of $25 USD. Payments can be requested every 24 Hours. Payment processing can take up to 2 days from the request date. Payments will generally be paid out via PayPal.

Refunds

In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

Usage and Obligations

Affiliates are permitted to use the Lucaneo brand and marketing resources available in the Affiliates section of the Lucaneo application. Logos and other assets cannot be modified. The Affiliate does not gain any trademark, copyright or any other rights to these materials.

The Affiliate will never imply that they are acting on behalf of Lucaneo and will never advertise Lucaneo products directly. The Affiliate will never bid for advertisements that compete with Lucaneo.

The Affiliate will never represent themselves, Lucaneo or their relationship with Lucaneo in a false or misleading way.

The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing Lucaneo.


Term and Termination

Either party has the right to terminate the agreement immediately without prior notice.

If the Affiliate terminates the agreement, no further commissions from Lucaneo will be paid for any past or future customer transactions.

If Lucaneo chooses to terminate the agreement, any balance greater than $25 USD will be paid to the affiliate within 60 days of termination. Balances that are smaller than $25 will be forfeited.

If the Affiliate is on a recurring program, Lucaneo will not be obligated for any future payments after termination.

Governing Law

This Agreement shall be governed, construed, and enforced in accordance with the laws of the State of Arizona, without regard to its conflict of laws rules.

Arbitration

All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the State of Arizona. An award of arbitration may be confirmed in a court of competent jurisdiction.

Modification

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.

This Privacy Policy applies only to our online activities and is valid for visitors to our website with regards to the information that they shared and/or collect in Lucaneo. This policy is not applicable to any information collected offline or via channels other than this website.

Lucaneo follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services' analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users' movement on the website, and gathering demographic information.

Cookies and Web Beacons

Like most websites, Lucaneo uses 'cookies'. These cookies are used to store information including visitors' preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users' experience by customizing our web page content based on visitors' browser type and/or other information.

Advertising Partners Privacy Policies

You may consult this list to find the Privacy Policy for each of the advertising partners of Lucaneo.

Third-party ad servers or ad networks uses technologies like cookies, JavaScript, or Web Beacons that are used in their respective advertisements and links that appear on Lucaneo, which are sent directly to users' browser. They automatically receive your IP address when this occurs. These technologies are used to measure the effectiveness of their advertising campaigns and/or to personalize the advertising content that you see on websites that you visit.

Note that Lucaneo has no access to or control over these cookies that are used by third-party advertisers.

Third Party Privacy Policies

Lucaneo's Privacy Policy does not apply to other advertisers or websites. Thus, we are advising you to consult the respective Privacy Policies of these third-party ad servers for more detailed information. It may include their practices and instructions about how to opt-out of certain options.
